What bugged me was when my coworker walked in with his new shiny iphone and said lets do a speed test. Now I love my instinct. But don't you know he consistently had better DL speeds?

Try the test using Opera Mini 3. It seems to give much better results. The built in browser may be the limiting factor assuming the signal is good and Hi Speed.  (Yes... I know you can't use the keyboard with Opera. Please see elsewhere in this forum for hints if needed. :-)

I think the download speed are faster on the instinct but the iphone has a faster processor.

The phone was a problem. I got a new one and am at least now capable of getting speeds over 300.

By using the Opera browser, you are proxying through Opera's internet circuits and just pulling down screen shots. That's what makes it amazing. All the processing and downloading of heavy stuff is cached on the Opera side. When you run the speedtest, you get the speed of Opera's circuits, not your own connectivity.
